Terms
These terms cover your use of the Wherestan website at wherestan.com and its API (the "service"). By using the service, you accept these terms. If you do not accept them, do not use the service. Wherestan is operated by Burak Ozdemir, a self-employed trader (autónomo) established in Spain, at Calle Puerto 14, 5th floor, 29016 Málaga, Spain. In these terms, "we" means the operator. Our Privacy Policy describes how we handle your information.
Who can use it
You can play without an account. You must be at least 13 years old to create an account. If the law where you live sets a higher minimum age for consenting to online services, that age applies to you instead.
Your account
You can create an account with Google, or with an email address and a password. You are responsible for activity under your account and for keeping access to it secure. Signing out does not delete your account.
Usernames
Your username is public: the leaderboard shows it. A username must follow these rules:
- 3 to 32 characters: letters a–z, digits 0–9, dots and underscores. Capital letters A–Z become lower case.
- No dot or underscore at the start or at the end, and no two dots in a row.
- No name that is taken or reserved, such as admin or support.
- No offensive name, and no name that pretends to be another person or Wherestan.
Our filter refuses some offensive words, but it cannot find all of them. A username that you choose when you sign up with email cannot be changed. An account made with Google gets a generated username, which you can change one time. We can hide a player from the leaderboard, for example for an offensive username. The account and its data stay.
Playing fairly
Play in good faith. Do not use bots, scripts or automated guessing. Do not try to get the answer before your game ends, for example by reading network traffic or by any other route around the game. Do not make more than one account to change the leaderboard.
Do not scrape the site, resell access to it or place unreasonable load on it. Do not tamper with the game, its requests or the data that it saves in your browser.
Our server scores every guess. The leaderboard counts only the games that our server recorded while you played signed in, from your first guess. Results that a browser keeps never count. A result that comes from automation or tampering is not ranked, and we can hide the player from the leaderboard. A rank or a streak has no money value and does not give a right to a prize.
The daily game and its data
Countries and Flags each have a daily answer, the same for all players on the same local date, and six guesses. Countries compares your guess with the hidden country through six clues, distance and direction. Flags reveals parts of the hidden flag where your guessed flag has a matching colour in the same position. You must guess the correct country to win, even if the whole flag is already visible. The two games keep separate progress, statistics and leaderboards.
The country names and facts come from public sources; those whose licences ask for a credit are named on the Sources page. We select these values, convert them between units and round them for the game. They can contain errors, be out of date or differ from other sources. None of these sources endorses Wherestan.
Flag artwork comes from flag-icons, used under the MIT licence. We keep a versioned copy and normalize its colours for comparison. Countries whose normalized flags are identical remain available as guesses but are excluded from daily Flags answers.
Pro
Pro gives your account Unlimited rounds: new Countries and Flags rounds whenever you want, with six guesses each. A round ends 24 hours after it starts. Unlimited rounds have their own statistics and never count for the leaderboards or the daily streaks. The daily games, their statistics, sync and the leaderboards stay free.
- Who sells Pro. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you buy Pro on the website, your purchase contract is with Paddle under Paddle's Buyer Terms. Paddle shows on your receipt and on your card or bank statement, and it collects and pays any tax that applies. These terms give you the right to use Pro and set how you use it. In the Wherestan iPhone app, you buy Pro through Apple's App Store, and Apple's terms apply. We may change our merchant of record; we will update these terms first.
- Plans and prices. Pro is a monthly subscription, a yearly subscription or a one-time purchase. Prices include any VAT or sales tax. The checkout shows the price, the tax and the total before you pay.
- Renewal and cancelling. A subscription renews automatically at the end of each period, for the same period, at the price at that time, until you cancel it. Before you pay, the Pro panel shows the renewal price and how often it renews. You can cancel at any time in Account, under Manage Pro, or through the link in Paddle's receipt email. Pro then stays until the end of the period that you paid for, and the subscription does not renew. A one-time purchase does not renew.
- Changing plans. On the website, you can change a monthly subscription to yearly in Account. Before you confirm, we show the amount that Paddle then charges at once to your saved payment method; the unused time of your current month is taken off. You can also change a website subscription to the one-time purchase in Account: the unused time of your current period is taken off its price, and the subscription ends when the payment is confirmed.
- Price changes. A new price applies from your next renewal. We tell you by email before that renewal, so that you can cancel first.
- Failed payments. If a renewal payment fails, Pro continues while Paddle retries the payment, for up to 30 days. If the payment does not succeed, the subscription ends.
- Refunds. Our Refund Policy describes your right of withdrawal and how to ask for a refund. Paddle makes every refund, to your original payment method.
- Ending Pro for a reason. If we close your account because you broke these terms, Pro ends with it, and no refund is due unless mandatory consumer law requires one. If we close your account for no such reason during a paid period, you get a refund of the unused part.
- Payment disputes. If you do not recognize a charge, contact us or Paddle at paddle.net first. Pro can be paused while a dispute is open.
Pro belongs to the account that bought it and cannot be moved to another account.
Availability
The daily games are free to play. We do not promise that the service will be available every day or without interruption, that your results or streaks will never be lost, or that every defect can be corrected immediately. Features can change. The service depends on third-party services, which can fail.
What belongs to whom
The Wherestan name, logo, software and original design are protected to the extent permitted by law. Third-party data and content keep their own rights and licences; the licences of the country data are set out on the Sources page, and the licence of the flag artwork above. You may share your own results, screenshots and the share text that the game gives you. You may not copy the site's content for another product, or present the game as your own.
Deleting your account
You can delete your account at any time in Account, or through our API. To confirm, you type your username. This deletes your account (email address, username and password hash), your Google link, the copies of your days on your account, the games and guesses that our server recorded (so you leave the leaderboard), your Unlimited rounds, your API access tokens, all your sign-in sessions and a password-reset request that you did not use. You cannot undo this. A Pro record stays without your account, as proof of the purchase. Deleting your account does not cancel a Pro subscription: cancel it first in Manage Pro, or on your iPhone in Settings. The days saved in each browser stay there; you can remove them in your browser settings.
No warranty, and limits on liability
The service and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. Country information comes from third parties and can be inaccurate or out of date. It is offered for a game and must not be relied on for travel, safety or any other decision that matters.
To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for lost data, profits or goodwill, arising from your use of the service. Nothing here excludes liability that cannot lawfully be excluded, and if you deal with us as a consumer, your statutory rights are unaffected.
Changes
We may update these terms. The date below always shows when they last changed, and material changes will be brought to your attention through the service where appropriate. Changes do not remove existing mandatory consumer rights.
Law
These terms are governed by the laws of Spain, and the courts of Spain have jurisdiction. If you use the service as a consumer in another country, you keep the protections of the mandatory law where you live.
